These Terms of Service (“Terms”) govern your use of www.shonkti.com and any purchase from Shonkti Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Nongkseh, Shillong CIN U47820ML2023PTC014059 (“Shonkti”, “we”, “us”). By accessing the Website or placing an order, you accept these Terms. If you do not agree, do not use the Website.
2.1 Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under Indian law. Minors may use the Website only under the supervision of a parent or guardian, who accepts these Terms on their behalf.
2.2 Your account
You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that breach these Terms.
2.3 Products and descriptions
We try to display products, colours, dimensions, and descriptions accurately. However, we do not warrant that descriptions, images, or other content are complete, accurate, or error-free. Handcrafted and natural products will vary. Product images are for illustration only. Jewellery weights, stone details, and metal purity are as stated on the product page; any hallmarking is as indicated for that item.
2.4 Pricing and payment
- All prices are in Indian Rupees (INR) and include or exclude applicable taxes as shown at checkout.
- We may change prices at any time without notice. The price at the time you place your order applies.
- We may cancel orders affected by pricing or typographical errors and will refund any amount paid.
- Payments are processed by third-party payment gateways. We do not store your full card details and are not responsible for gateway errors, delays, or failures.
2.5 Order acceptance
Your order is an offer to purchase. A contract is formed only when we dispatch the item or send a written acceptance. We may refuse, limit, or cancel any order at our discretion, including for suspected fraud, unavailability, or errors.
2.6 Shipping and delivery
Delivery timelines are estimates, not guarantees. We are not liable for delays caused by couriers, weather, strikes, natural events, government actions, customs, incorrect addresses, or other events beyond our reasonable control. Risk of loss passes to you on delivery to the address you provided. You are responsible for providing a complete and accurate address and for being available to receive the delivery.
2.7 Returns and refunds
Returns, exchanges, and refunds are governed by our Return & Exchange Policy, which forms part of these Terms.
2.8 Product use, care, and safety
Products must be used and cared for as per the instructions provided. Furniture must be assembled and used as intended, within stated weight limits, and kept away from moisture, direct heat, and sunlight. Small parts in decor and jewellery may be a choking hazard; keep them away from young children. Natural materials, dyes, and finishes may cause allergic reactions in some people; it is your responsibility to check material information before purchase. Colours in some textiles may bleed on first wash.
2.9 Intellectual property
All content on the Website, including text, images, logos, designs, product photographs, and software, is owned by or licensed to Shonkti and protected by law. You may not copy, reproduce, modify, distribute, or use any content for commercial purposes without our prior written consent.
2.10 User conduct
You agree not to: use the Website for unlawful purposes; attempt unauthorised access to our systems; introduce malware; scrape or harvest data; submit false or misleading information; place fraudulent orders; or post reviews or content that is defamatory, abusive, infringing, or unlawful.
2.11 Reviews and user content
By submitting reviews, photos, or other content, you grant Shonkti a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, and reproduce it. You confirm you own or have rights to the content. We may remove any content at our discretion.
2.12 Third-party links and services
The Website may link to third-party sites or use third-party services (couriers, payment gateways, marketplaces). We do not control and are not responsible for their content, policies, or practices.
2.13 Disclaimer of warranties
To the fullest extent permitted by law, the Website and all products and services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be excluded by law. We do not warrant that the Website will be uninterrupted, secure, or error-free.
2.14 Limitation of liability
To the fullest extent permitted by applicable law:
- Shonkti, its directors, employees, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from your use of the Website or products.
- Our total aggregate liability for any claim relating to an order or the Website shall not exceed the amount you actually paid for the product(s) giving rise to the claim.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection laws.
2.15 Indemnity
You agree to indemnify and hold harmless Shonkti, its directors, officers, employees, and affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website or products, or your violation of any law or third-party right.
2.16 Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, riots, strikes, power or internet failures, supply-chain disruption, or government restrictions.
2.17 Suspension and termination
We may suspend or terminate your access to the Website at any time, with or without notice, if we believe you have breached these Terms or applicable law.
2.18 Governing law and dispute resolution
These Terms are governed by the laws of India. Parties will first try to resolve any dispute amicably by written notice to customercare@shonkti.com. Failing resolution within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by Shonkti [or by mutual consent]. The seat and venue shall be Shillong, India, and the language shall be English. Subject to this, the courts at Shillong, India shall have exclusive jurisdiction. This does not limit any rights you have under mandatory consumer protection law.
2.19 Changes to the Terms
We may update these Terms at any time by posting the revised version on the Website. Continued use after changes means you accept them.
2.20 General
- Entire agreement: These Terms, the Privacy Policy, and the Return & Exchange Policy form the entire agreement between you and us.
- Severability: If any provision is found unenforceable, the rest remain in effect.
- No waiver: Failure to enforce any right is not a waiver.
- Assignment: We may assign these Terms; you may not without our written consent.
